These Terms & Conditions outline the responsibilities of Nest Guardians, parents, students, and host families. They set clear standards for safety, welfare, and guardianship services, ensuring international students in the UK receive professional care and reliable support.
Terms & Conditions – Nest Guardians
1. Definitions
- Nest Guardians means Nest Guardians Ltd.
- Parents means the parents or legal guardians of the Student.
- Student means the student to whom this agreement relates.
- School means the school at which the Student is enrolled.
- Programme means the guardianship services offered to the Student by Nest Guardians.
2. Nest Guardians’ Obligations
- To assume parental responsibility during term time where appropriate, including granting consents required by the School.
- To liaise with both the School and the Parents, ensuring the Student’s welfare throughout the Programme.
- To arrange transport for the Student between UK ports of entry/exit and the School, subject to reimbursement.
- To take reasonable steps to monitor the Student’s independent travel plans and notify Parents accordingly.
3. Parents’ Obligations and Confirmations
- Parents confirm Nest Guardians is legally entitled to act as guardian for the Student.
- Parents delegate parental authority to Nest Guardians during the Programme, except when the Student is directly in their care.
- Parents agree to provide any authorisations required by the School to share the Student’s academic and conduct records.
- Parents authorise Nest Guardians to delegate responsibilities to the School when necessary.
- Parents confirm the Student’s medical details and accept that, in urgent cases, Nest Guardians may act without explicit parental consent.
- Parents remain responsible for Programme fees and must ensure the Student complies with Nest Guardians’ rules and Student Charter.
- Parents indemnify Nest Guardians against reasonable costs, claims, or losses incurred in carrying out its responsibilities.
4. Termination
- Either party may terminate this Agreement with at least one full term’s written notice.
- Expulsion or persistent unreasonable behaviour by the Student may result in immediate termination without refund.
5. Change of School
- Nest Guardians will not transfer the Student to another school without written parental consent.
6. English Law
- This Agreement is governed by English Law, and Parents agree to the jurisdiction of the English Courts.
7. Limitation of Liability
- Nest Guardians is not responsible for acts or omissions of the School or third-party course providers.
- Visa and entry requirements remain the responsibility of Parents and the Student.
- Nest Guardians cannot be held liable for accidents or omissions except where expressly covered in this Agreement.
- Students are advised to have their own third-party insurance.
- In the event of a pandemic or contagious outbreak, Nest Guardians may require medical certificates and retains the right to refuse care.
8. Promotional Material
- Photographs may be used for reports, identification, or promotional purposes unless Parents notify Nest Guardians in writing.
9. Entire Agreement
- This Agreement supersedes any prior agreements between Nest Guardians and the Parents.
10. General
- If any provision is found unenforceable, the remainder of the Agreement shall continue in effect.
Terms & Conditions – Host Family
- All host family members over 16 are subject to Disclosure and Barring Service (DBS) and Local Authority checks.
- Medical history may be requested and stored in line with data protection laws.
- Host families must comply with the Children Act 1989, confirming no household member has convictions or prohibitions relating to child care.
- Families must notify Nest Guardians of any household changes for further checks.
- Families must inform their insurance provider that they are hosting students and confirm public liability cover.
- Vehicles used to transport students must have appropriate insurance coverage.
- Households must ensure safe internet and device access.
- An annual Gas Safety check by a Gas-Safe registered engineer is mandatory, with certification uploaded to Nest Guardians.
- Nest Guardians reimburses host family expenses promptly as per the Host Family Handbook.
